1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. The Services

Realium provides a suite of tools for real estate professionals, including AI-assisted content generation, comparative market analyses (CMAs), lead and contact management, marketing, deal analysis, document generation, and website building. We may add, modify, or discontinue features at any time.

3. Subscriptions, Trials & Billing

Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends. You may cancel at any time from your billing portal; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable. We may change pricing on prospective notice.

4. Acceptable Use

You agree not to:

• Use the Services in violation of any law, regulation, or third-party right;
• Send spam or unsolicited communications, or violate anti-spam, telemarketing, or fair-housing laws;
• Upload data you lack the right or consent to use;
• Reverse engineer, scrape, overload, or attempt to gain unauthorized access to the Services;
• Misrepresent AI-generated output or use it deceptively.

5. Your Content & Data

You retain ownership of the content and data you submit to the Services (“Your Content”). You grant us a non-exclusive, worldwide license to host, process, and display Your Content solely to operate and improve the Services for you. You represent that you have all rights and consents necessary to provide Your Content, including any contact or property data about third parties, and that its use through the Services complies with applicable law.

6. AI-Generated Output

The Services use artificial intelligence to generate text, valuations, and other output. AI output may be inaccurate, incomplete, or unsuitable for a given purpose. CMAs and deal analyses are estimates, not appraisals or financial advice. You are solely responsible for reviewing, verifying, and editing all output before relying on, publishing, or distributing it, and for ensuring it complies with applicable laws and professional obligations.

7. Third-Party Services

The Services may integrate with third-party platforms (e.g., payment, email, social, MLS, and AI providers). Your use of those services is governed by their own terms, and we are not responsible for their availability, content, or practices.

8. Intellectual Property

The Services, including all software, design, and trademarks, are owned by Realium and its licensors and are protected by intellectual property laws. Except for the limited right to use the Services under these Terms, no rights are granted to you.

9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT OUTPUT WILL BE ACCURATE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REALIUM AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Realium and its affiliates from any claims, damages, liabilities, and expenses arising out of Your Content, your use of the Services, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms or to protect the Services. Upon termination, your right to use the Services ceases, and we may delete your data subject to our Privacy Policy and applicable law.

13. Data Deletion

You may request deletion of your account and associated personal data at any time. To do so, delete your account from your account settings or email [email protected] from the address on file. We will verify your request and permanently delete or irreversibly anonymize your personal data within 30 days, except where we are required or permitted to retain it. 14. Changes to These Terms

We may update these Terms from time to time. We will post the updated version with a revised “Last updated” date, and material changes may be communicated to you. Your continued use of the Services after changes become effective constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in Florida, unless otherwise required by applicable law.
